Terms of booking

The short version: we quote a journey rather than sell a package, nothing is booked until you have it in writing, and a printed card confirms it.

These terms are not final

Shunyaway is not yet taking bookings. The structure below is settled; every figure in it — the deposit, when the balance falls due, and the payment methods — is still being set with our accountants and is marked to be confirmed.

Nothing here is an offer, and no journey can be booked from this website today. When you do book, the terms in force will be sent to you in writing, in full, before you pay anything.

1. Who you are contracting with

Shunyaway Experiences Pvt. Ltd., a company registered in India at Rajpur Road, Dehradun 248001, Uttarakhand, India. In these terms “we” is that company and “you” is the person making the booking, who is responsible for everyone named on it.

2. How a journey is agreed

  • You enquire. Nothing is owed and nothing is held.
  • We propose a journey and a price for it. Rates on request throughout the site because a door-to-door journey cannot be priced until we know which door and which cabin.
  • A journey becomes a booking only when we confirm it in writing and the deposit has been received. A quotation on its own binds nobody.
  • Confirmation is acknowledged twice: by email the same day, and by a printed card in the post.

A quoted price holds for the journey as quoted. If you change the dates, the party size, the cabin or the route, we re-quote — and we will always show you what changed before you agree to it. Government charges, airline surcharges and taxes introduced after your booking are passed on at cost, with the evidence.

4. Flights

Return international flights are included by default, from your nearest major airport, in the cabin you choose. You may opt out and arrange your own, in which case the rate is adjusted. Where we hold the tickets, the airline’s own conditions of carriage apply to the flight itself, and delays or cancellations by an airline are handled under §8.

5. Passports, visas, and health

  • A valid passport and the correct Indian visa are your responsibility. We will tell you what is needed and when to apply, and we will check what you tell us — but we cannot apply on your behalf, and a refused or late visa is not a reason we can refund outside §7.
  • Several journeys reach altitude — Kedarnath at 11,755 ft, Spiti above 14,000 ft. You must tell us about any condition affecting your fitness to travel at altitude, and we may ask for a doctor’s confirmation. This is not bureaucracy: at those heights, evacuation is measured in hours.
  • Travel insurance is a condition of booking, and it must cover medical treatment, evacuation from remote areas, and cancellation. We will ask to see it.

6. What we will change, and when

Himalayan journeys are governed by weather, road and the temple calendar. We reserve the right to alter a route, a property or an order of days where safety or access requires it, and we will substitute something of equivalent standard. If a change is significant and you would rather not travel, §7 applies.

We may also cancel a journey ourselves — for safety, or if a minimum party size is not reached where one was agreed. If we do, you may take a full refund of everything paid to us, or move to another date. We do not pay consequential losses, which is what your insurance is for.

8. Things outside anyone’s control

Neither of us is liable for failing to perform because of events beyond reasonable control: weather, landslide, earthquake, epidemic, war, civil unrest, strike, airline collapse, or a government closing a road or a shrine. Where this happens we will do everything practical to get you home or to an alternative, and we will pass on any refunds we recover from suppliers.

9. Our liability

We are liable for our own negligence and that of our employees, and nothing here limits liability for death or personal injury caused by it, or for fraud. We are not liable for the acts of independent third parties — airlines, hotels, transport operators — beyond taking reasonable care in choosing them. Our liability for anything else is limited to the amount you paid us for the journey.

10. Behaviour

You are travelling in places that are sacred to the people who live in them. We may end a journey, without refund, for conduct that endangers others or gives serious offence at a shrine or in a private home. This has never happened and we would like to keep it that way.

11. Complaints

Tell your guide first — most things can be put right on the day. Anything unresolved should reachconcierge@shunyaway.com within 28 days of your return, and we will reply within 14 days.

12. Law

These terms are governed by the law of India, and the courts of India have jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of your own country.
